VISION MONDAY® DISPENSING AND RETAIL EXCELLENCE (“D.A.R.E”) OFFICIAL CONTEST RULES 2013


Sponsors: Jobson Medical Information LLC, 100 Avenue of the Americas, NY, NY 10013, the publisher of Vision Monday® (“ JMI”)and Europa International   (together, the “ Sponsors” or “ we”).

In this contest (the “ Contest”), you may nominate any optical retailer who meets the require-ments below, for a D.A.R.E award in any or all of six categories.

WHO IS ELIGIBLE TO SUBMIT A NOMINATION?

Anyone may submit a nomination. You don’t have to be a retailer.

WHO IS ELIGIBLE TO BE NOMINATED?

You may nominate any (i) U.S. or Canadian retailer or eyecare professional (ii) whose primary function is retailing or dispensing prescription eyewear or sunwear, and (iii) that has been continuously operating since May 1, 2012 and is still in operation (a “ Qualifying Retailer”). You may even nominate your own company if it is a Qualifying Retailer.

HOW DO I NOMINATE A RETAILER?

Between 12:00 am on May 6th and 11:59 pm on June14th, submit the name of a Qualifying Retailer in one or more of the six categories through the Contest submission form, along with a statement of between 150 and 500 words (a “ Statement”) and any supporting materials that you think show why each retailer you have nominated deserves to win in the categories in which you have nominated that retailer (“ Supporting Materials”). If we ascertain that a retailer that has been nominated is not a Qualifying Retailer, we will remove that retailer’s name from consideration without notifying you. If you do not complete all the fields in the submission form for any nomination, we will not consider that nomination, without notifying you. You may nominate any Qualifying Retailer only once in each category. Any Supporting Material that you submit with any nomination will become the property of JMI and will not be returned to you.

ARE THERE ANY LIMITATIONS ON WHAT I CAN SAY OR THE SUPPORTING MATERIALS I CAN SUBMIT AS PART OF A NOMINATION?

You may not make any Statement or submit any Supporting Material that (i) defames, misrepresents or contains disparaging remarks about other people, companies, or products, including JMI; (ii) is sexually explicit, profane, pornographic, unnecessarily violent or dero-gatory of any ethnic, racial, gender, religious, professional or age group; (iii) promotes the use of alcohol, illegal drugs, tobacco, firearms/weapons or a particular political agenda; or (iv) is obscene or offensive. You also may not submit any Supporting Material that is marked “confi-dential,” “internal only,” or “not for distribution,” or that in some other way indicates that it is not for public circulation or public display. We may reject any nomination that is accompanied by a Statement or Supporting Materials that we determine, in our sole discretion, does not meet these criteria, without notifying you.


If you submit any Supporting Materials, you promise us that you have the right to provide those Supporting Materials to us for us to reproduce and display publicly on the Contest page and/or on any of JMI’s other websites and any of Europa International’s websites, and in the print edition of Vision Monday®.


WHAT MAY YOU DO WITH ANY STATEMENTS I MAKE AND ANY SUPPORTING MATERIALS I SUBMIT IN CONNECTION WITH ANY NOMINATION?

By submitting a nomination, you grant us the right to reproduce (copy), distribute copies of (transmit), publicly display (post on any web site or elsewhere online or publish in print), and publicly perform (read out loud) any statements you make and any supporting materials you submit. We also may combine your Statement and Supporting Materials with other content in our sole discretion.

In addition, by submitting a nomination, you give each Sponsor permission to use your name, statement, and likeness for purposes of advertising, promotion and trade, in any medium, without paying you or giving you anything.


HOW WILL THE WINNERS BE CHOSEN AND NOTIFIED?

At the end of the submission period, a panel of judges, whose bios are available on the Contest page, will review all the nominations and decide, based on their experience, which three Qualifying Retailers in each category should be eligible to win in that category. The judges also will decide, based on their review of all nominations, Statements and Supporting Materials, which Qualifying Retailers should be eligible for a separate “We the People” award. (A Qualifying Retailer does not have to be one of the top three in any category to be eligible for the “We the People” award.) Then, from approximately July1st – August 9th, we will open up a public vote to choose the top single Qualifying Retailer in each category and the winner of the “We the People” award.

The editors of Vision Monday® will notify the winners and their names will be published in the September 9, 2013 issue of Vision Monday® and on JMI’s website at www.visionmonday.com and on JMI’s  social media websites, including but not limited to, www.SightNation.com ,  as well as the websites of Europa International, which are http://www.europaeye.com, http://cinziadesigns.com, http://www.detari.com, and   http://www.adinthomas.com.

RELEASE OF LIABILITY

You release JMI and Europa International, their directors, employees, officers, parents, subsidiaries, affiliates, distributors, advertising and Contest agencies, and all others associated with the development and execution of the Contest, from any and all liability with respect to or in any way arising from the Contest.
